 “CHALLENGES OF CONCLUDING ELECTRONIC EMPLOYMENT CONTRACTS IN THE REPUBLIC OF ARMENIA

Abstract

The system of electronic employment contracts was introduced in the Republic of Armenia by the law ‘On Amending and Supplementing the Labor Code of the Republic of Armenia,’ adopted in December 2024 and entering into force on July 1, 2025. The aforementioned legal acts provide for the conclusion of employment contracts through an electronic system. The state has, of course, developed and adopted a number of legal acts through which the aforementioned field has been regulated. Until now, the conclusion of electronic employment contracts in the Republic of Armenia has been carried out on a voluntary basis.

Globally and within the Republic of Armenia, the execution of electronic employment contracts addresses several critical issues, including reducing the number of undeclared workers among most employers and safeguarding employees’ rights. Throughout the regulation of labor relations, guidance must be drawn from labor legislation and the series of legal acts established by the state.
Nonetheless, the widespread implementation of electronic employment contracts in the Republic of Armenia faces several challenges. This work analyzes current legislative regulations and identifies existing gaps and contradictions, particularly regarding the use of electronic signatures, the legal validity of contracts, party identification, and personal data protection. Furthermore, practical obstacles are examined, including technical infrastructure limitations and digital literacy levels.
