Abstract
The article is devoted to the issues relating to remedies to the right to adjudicate the case within a reasonable time in the context of labor disputes.
In the light of the case law of the European Court of Human Rights, the article focuses on the issues of violation of terms of the settlement of labor cases, the unacceptability to put all the financial burden of such breaches on the employer, who is obliged to pay average salary for the entire period of forced idleness, as well the effective remedies of the employer against such violations. These issues are very actual, given that the breaches of the settlement terms are systematic and result in imposing an excessively disproportionate burden on the employer.
In this connection, to the necessary extent, the legal positions of the Constitutional and Cassation Courts of the Republic of Armenia regarding the length of the proceedings on labor disputes and the distribution of the material consequences thereof between the parties are also presented.
